Welcome to the website of the Power Washers of North America ("PWNA," "we," "us," or "our"), located at pwna.org. These Terms & Conditions ("Terms") govern your access to and use of our website, membership programs, certification courses, events, and related services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

1. Who We Are

PWNA is a non-profit trade association serving the exterior cleaning industry, providing education, certification, compliance training, and networking opportunities for contractors, vendors, and industry professionals across North America.

2. Eligibility

By using our Services, you represent that you are at least 18 years old and have the legal authority to enter into these Terms on your own behalf or on behalf of an organization you represent (such as a contracting business).

3. Membership

3.1 Membership Tiers. PWNA offers Contractor, Enterprise, and Vendor membership tiers, each with its own benefits, pricing, and terms, as described on our Membership pages.

3.2 Application and Acceptance. PWNA reserves the right to accept or decline any membership application at its sole discretion.

3.3 Fees and Renewal. Membership fees are due as outlined at checkout or in your membership agreement. Memberships may renew automatically unless cancelled in accordance with our Cancellation Policy.

3.4 Termination. PWNA may suspend or terminate a membership at any time for violation of these Terms, PWNA's Code of Conduct, or conduct that PWNA determines, in its sole discretion, to be harmful to the organization or its members.

4. Certification & Training Programs

4.1 Educational Purpose. PWNA's certificate courses, technical training, and safety/compliance programs are provided for educational purposes to promote industry best practices.

4.2 No Guarantee of Outcomes. Completion of a PWNA certification does not guarantee business success, project outcomes, regulatory compliance, or that a certified individual will perform work safely or competently. Certification reflects completion of PWNA's training curriculum only.

4.3 Independent Contractors. PWNA-certified individuals and companies are independent business owners, not employees, agents, or representatives of PWNA. PWNA does not supervise, control, or take responsibility for the work performed by any contractor, member, or certified individual.

5. Find a Contractor / Vendor Directory

PWNA's Find a Contractor and Vendor Directory listings are provided as a convenience to help users locate industry professionals. Inclusion in a directory is not an endorsement, warranty, or guarantee of the quality, licensing, insurance, or workmanship of any listed individual or company. Users engaging with any listed contractor or vendor do so at their own discretion and risk, and PWNA is not a party to any agreement between users and directory listings.

6. Events (Including ELEVATE and Regional Events)

6.1 Registration for PWNA conventions, regional events, or trainings is subject to the pricing, deadlines, and refund terms stated at the time of registration and in our Cancellation Policy.

6.2 PWNA reserves the right to modify event dates, locations, speakers, or content, or to cancel an event, due to circumstances beyond its reasonable control.

7. Website Use & Acceptable Conduct

You agree not to:

  • Use the Services for any unlawful purpose
  • Attempt to gain unauthorized access to any portion of the website or PWNA's systems
  • Interfere with the proper functioning of the website or mobile app
  • Submit false, misleading, or fraudulent information (including in membership applications, directory listings, or reviews)
  • Use content from the Services to compete with or disparage PWNA without authorization

8. Intellectual Property

All content on the PWNA website — including text, graphics, logos, course materials, certification marks, and the PWNA name and logo — is the property of PWNA or its licensors and is protected by copyright and trademark law. You may not reproduce, distribute, or create derivative works from this content without PWNA's prior written consent.

9. Payments

All payments for memberships, certifications, and events are processed securely through third-party payment processors. PWNA does not store full payment card information. Refunds, where applicable, are governed by our Cancellation Policy.

10. Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. PWNA does not warrant that the website will be uninterrupted, error-free, or secure.

11. Limitation of Liability

To the fullest extent permitted by law, PWNA and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Services, your reliance on any content on the website, or your engagement with any PWNA member, contractor, or vendor.

12. Indemnification

You agree to indemnify and hold harmless PWNA and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

Our website may contain links to third-party websites (including sponsor, vendor, and partner sites). PWNA does not control and is not responsible for the content, policies, or practices of any third-party site.

15. Governing Law

These Terms are governed by the laws of the State of Ohio, without regard to its conflict of laws principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Ohio. (Confirm this is the jurisdiction PWNA wants to designate before publishing.)
